يشكل ميثاق روما النظام الأساسي لمحكمة الجنايات الدولية، صدر الميثاق في العام 1998م، ووقعت عليه دولة فلسطين بعد الاعتراف الدولي بها بصفة دولة عضو مراقب في الأمم المتحدة، وتضع المحكمة الأساس لمحاسبة مجرمي الحرب ضمن الاجراءات الواردة في النظام الخاص بالمحكمة، والذي يحدد أيضاً ماهية جريمة الحرب.
